DEFINITIONS 1.1 In these Terms and Conditions:​ "We", "Us", "Our", and "Fit Removals" refer to the contractor(s) performing the services. "You" and "Your" refer to the customer entering into this agreement. "Contractor" means the person or entity providing the services identified in the Quote Form. "Goods" include all items subject to the services, including packaging and containers. "Dangerous Goods" refers to any items that may be flammable, explosive, corrosive, infectious, or hazardous. "Services" include removal, packing, unpacking, storage, and other related services described in the Quote Form.

CONTRACT AGREEMENT 2.1 By accepting a quote and allowing us to begin services, you agree: a) To enter a binding contract with Fit Removals and its contractors; b) That you have the authority to act on behalf of all persons represented; c) That Fit Removals acts as an agent for its contractors and holds no liability for the actions of the contractors performing services; d) That claims must be directed to the specific contractor who performed the service.

INFORMATION AND DISCLOSURE 3.1 You warrant that all information provided to Fit Removals is accurate and complete. 3.2 Prior to quoting or providing services, you must: a) Provide an accurate estimate of the volume of goods; b) Notify us of:

Dangerous Goods;

Fragile or valuable items exceeding $1,000 in value;

Items requiring special handling or care.

OUR RIGHTS 4.1 We may refuse to perform services at our discretion. 4.2 We determine how and when services are performed. 4.3 Service times are estimates only. We are not liable for delays. 4.4 Goods must be in a condition suitable for transport. We are not responsible for damage resulting from improper packaging unless we provided packing services. 4.5 If information you provide is inaccurate, we may revise our quote or charges accordingly.

YOUR WARRANTIES 5.1 You warrant that: a) All goods:

Are lawfully owned;

Comply with all regulations;

Do not include undisclosed Dangerous Goods. b) We and our contractors have access and authorization to enter all relevant premises. 5.2 If undisclosed Dangerous Goods are found, we may dispose of them at your expense and without liability.

REMOVAL SERVICES 6.1 We are not common carriers and accept no liability as such. 6.2 You must: a) Be present or represented at both pick-up and delivery; b) Ensure no goods are left behind or transported in error; c) Pay for extra services due to overlooked items or incorrect delivery. 6.3 If delivery is not possible due to your unavailability or site access issues, we may: a) Return goods to the pick-up location; b) Store goods at your cost; c) Attempt re-delivery at an additional charge. 6.4 We may refuse to move heavy or bulky items (e.g., pianos) unless disclosed. Extra fees apply and you assume all risks. 6.5 We may perform dismantling, hoisting, or obstruction removal only with prior agreement and at your sole risk and cost. 6.6 You must: a) Ensure access to loading docks/lifts; b) Provide adequate parking and access for our vehicles.

STORAGE SERVICES 7.1 Charges may change after 25 weeks with 4 weeks' notice. 7.2 We may transfer stored goods to a different location at no cost to you. 7.3 You may inspect goods with prior notice and may incur a fee. 7.4 Goods may be removed from storage with 7 days' written notice. 7.5 If you fail to collect goods after the storage term, we may sell them after 2 weeks’ notice. 7.6 Stored goods are not insured. You must arrange storage insurance separately.

OTHER SERVICES 8.1 Packing/unpacking, cleaning, locksmith, or other services must be booked separately. Extra fees apply.

CHARGES AND PAYMENTS 9.1 Standard rates and charges are listed in your quote. 9.2 Services are charged in 30-minute increments unless agreed otherwise. 9.3 Full payment is due one hour before job completion unless otherwise agreed in writing. 9.4 Storage must be paid in advance. 9.5 You must pay for all third-party and related costs, including tolls and parking. 9.6 We accept cash, bank transfer, and credit cards (Visa, MasterCard, Amex). A 2.5% fee applies to card payments. 9.7 Rescheduling may incur additional charges. 9.8 If a third party fails to pay, you remain liable. 9.9 Overdue payments attract interest at the CBA personal overdraft rate +3%. 9.10 All payments must be made in full without deductions or set-off.

GST All prices are GST inclusive unless otherwise stated.

LIEN 11.1 Goods are subject to lien until all outstanding amounts are paid. 11.2 If unpaid after 4 weeks, goods may be sold after 4 weeks’ notice to recover debt.

INSURANCE 12.1 We recommend arranging insurance. We can assist upon written request. 12.2 You assign to us all rights under any insurance policy upon our payment to you. 12.3 We may receive commission from insurance providers.

WE BREAK IT WE FIX IT GUARANTEE 13.1 We guarantee your items will be delivered undamaged or we will repair, replace, or reimburse at our discretion. 13.2 You must inspect goods upon delivery and report damages before the job is completed. 13.3 Exclusions apply to: a) Items not inspected at time of delivery; b) Fragile, perishable, valuable, or high-risk items; c) Damage from inherent defects, delay, or acts of God. 13.4 All damage claims must be submitted in writing within 48 hours of completion of the job. Claims submitted after 48 hours will not be accepted.

LIMITATIONS OF LIABILITY 14.1 Nothing excludes your rights under consumer law. 14.2 We exclude all liability for: a) Implied warranties except where non-excludable; b) Negligence or contract-based loss of profits, revenue, or consequential damages.

CANCELLATION POLICY 15.1 A $100 fee applies for cancellations within 48 hours. 15.2 Promotions do not apply to vans or trucks 3.5T or 4.5T. Subject to availability.

GENERAL TERMS 16.1 These terms supersede all prior agreements. 16.2 Invalid provisions are severable. 16.3 Waivers must be in writing. 16.4 Rights are cumulative. 16.5 We may amend terms with 2 days’ notice. If you disagree, you must terminate the contract. 16.6 These terms are governed by the laws of New South Wales, Australia.
